"Hope" Still Making the Rounds (and Tees)

Artist Shepard Fairey isn't out of the woods yet regarding the lawsuit the Associated Press filed against him for his use of an AP photo as the basis of his iconic "Hope" poster of President Obama. That case is still pending.
But, meanwhile, litigation or no litigation, the image of that poster continues to pop up. Today, while strolling around Dupont Circle in Washington, D.C., I saw the image of the "Hope" poster plastered on a T-shirt being marketed by a street vendor.
Now here's the question...Does the maker of the T-shirt have permission from Mr. Fairey to utilize the image (which the AP claims Mr. Fairey doesn't have the permission to use from coyright holder of the underlying photo)? If the shirt manufacturer doesn't, would Mr. Fairey have the nerve to claim infringement?
